Recommendations for Large Scale Land-Based Investments in Ghana: Background for the Model Lease and Community/Investor Guidelines of the Ghana Commercial Agricultural Project

This paper presents findings and recommendations related to large scale land-based investments (LSLBI) in Ghana. The paper serves as a backdrop for a Model Lease Agreement and Community/Investor Guidelines, developed by the authors through a consultancy to the Ghana Commercial Agriculture Project (GCAP) in 2014. These tools are aimed at improving LSLBI processes and outcomes in Ghana for both customary communities and investors, by providing step-by-step guidance for implementing best practices in regard to responsible investment. To provide context for these tools, the paper covers legal, policy and institutional issues related to both the formal and customary land tenure and investment frameworks in Ghana, and is centered around twelve practical findings and associated recommendations related to improved investment processes and outcomes. The paper emphasizes the need for extensive community consultation, participatory processes, meaningful consent, and equitable benefits sharing as the basis for successful investment, and provides recommendations for how to close the gap between investor and community expectations that has historically thwarted positive outcomes in Ghana.
