The electronic deed in German law

Wilsch, Harald

Honourable conference members! It is unfortunate but I have to assume that I will not even remotely reach the age of the Dutch Land Registry Office which celebrates its 175th birthday this year. For this reason I will have to content myself with occasionally being permitted to feel just as old, however, this is not a true consolation. Still at this present day it conforms already to my historic self-conception of being the same way as the Dutch Land Registry Office portrays itself to us: to be standing deeply inside the historic realms of the past and to be able to look back on 175 years of history, but in our present time already having arrived at cyberspace, the historic realms of the future, as the subject of this conference shows. Let me demonstrate a historic link from a German point of view: on the one end there is the era of Arthur Schopenhauer, the 19th.century, on the other the subject of todayys conference, Electronic Conveyancingg, cyberspace, the virtual realm, something Schopenhauer surely would not have been too fond of. In this context, may I quote an expression which we thank the pop culture of our British friends for: Standing on the Shoulders of Giants. One who is able to build on tradition is already closer to the future. If you are part of a long line of tradition having conquered many a path you will be able to access the future, too. The seemingly paradox says: to be modern seems to be easier when you can look back on a long past. Finally this shows what even a small people can be great att, as Eduard Maurits Meijers, the Leiden professor, said. But before this introduction gets as long as part three of the European constitutional agreement I would like to turn to the subject of the speech I am about to give. It is my honour and pleasure to introduce you to the electronic deed in German law.
