The Real State Registry system and prevention of real estate frauds in Brazil

The author presents the reasons for the creation of Brazilian real state registry system, highlighting its duties, its positive impacts on economy, and its importance to legal certainty on real states transactions. She also presents the registry of rights as an important tool for real state fraud prevention, since it avoids the false document registration, real state frauds through lawsuits, frauds against consumers, and frauds against credit institutions based on overload on properties. The author concludes that the Brazilian Real State Registry system can serve as a parameter for countries lacking institutional improvements in their real estate right disclosure systems in order to improve their mechanisms of control by private entities and the Government and to promote fast and reliable real estate transactions.
