The system of perpetual usufruct of land owned by state treasury and local government in Poland

Perpetua l usufruct of state land was established in Poland in 1961. Originally, it was applied only to land located in towns and settlements intended for residential buildings constructed by private entities and housing cooperatives. After 1989, this form of holding state property lost its original character. The enfranchisement of state and municipal legal entities that began in 1990 resulted in perpetual usufruct becoming applied to properties of various intended uses. Discussions concerning the future of this form of holding public property are currently being held in Poland. In 2005, the possibility was introduced of legally converting perpetual usufruct into ownership, subject to filing an appropriate application by 2012. However, this applies only to some perp etual usufructuaries (land intended for residential buildings, farming areas). The present study shows the development and main features of this form of right of property and describes its advantages and disadvantages from the point of view of the land owner (the State Treasury and local government units). It also indicates possible trends of transformation related to this land right.
